In response, Patel's defense motioned for a continuance to allow time to prepare for the new charges. That motion was granted, and on Friday the new trial was scheduled for Jan. 22.     UPDATE: Elkhart Police have taken the 2-year-old boy who was sent to the emergency room with suspicious injuries into protective custody, according to a press release by the Elkhart Police. The Elkhart Police said the boy remains hospitalized in Indianapolis, and his medical status has been upgraded to stable. The 2-year-old no longer requires a ventilator and is beginning to respond.
