Former South Bend police chief Darryl Boykins filed an official discrimination complaint with the South Bend Human Rights Commission on Friday.
Boykins claims that his demotion was due to his race. Boykins' lawyer, Tom Dixon, says the complaint was filed because the city has not responded to the former chief's tort claim. The complaint will be passed on the US Equal Employment Opportunity Commission Office in Indianapolis.
Dixon says the next step is up to the EEOC. They could offer both sides a mediation, or they could investigate the claim.
FOX28 contacted the mayor's office for a response to the complaint. The mayor said in a written response, "In general, it is the policy of this administration not to comment on pending litigation.
The mayor's office has not yet been served with formal notice or any documentation of
this legal action."
The mayor's office has said that Boykins was demoted in connection to an investigation into recorded phone calls at the South Bend Police Department.
