An important deadline came and went Thursday in the tale of the tapes.
The South Bend Common Council recently sent Mayor Pete Buttigieg a subpoena, giving him 30 days to release recordings made within the South Bend Police Department.
The tapes were at the center of an FBI investigation. There is widespread speculation that there are racial remarks on the tapes. The 30 day timeline expired Friday.
"The way we responded to the subpoena is to go to Federal Court and ask them for a green light to release the tapes," Mayor Buttigieg told FOX 28 Friday morning. "If they say yes then we can comply. If they say no then we can explain why we can't."
The Common Council's attorney says the mayor's move to take the case to Federal Court will cost more taxpayer money and create more delays. The Mayor says he's not trying to withhold anything. He says if the court says it's ok to release the tapes he will be the first to listen to them and take action if needed.
