It's been eight months since an apartment fire disrupted the lives of many South Bend residents. On January 6, 2012 a fire broke out at Park Jefferson and on June 17 residents filed a complaint wanting compensation for their losses.
The trial date hasn't been set yet, but the case was in the court room Wednesday.
Park Jefferson Realty's representative Jim Milestone requested a gag order. This would prevent all parties involved in the case from speaking with the press. In court he said he wanted a fair trial and didn't want the media attention to taint a jury's opinion of his client.
Peter Agostino, attorney representing the residents affected by the fire, argued that this was infringing on their freedom of speech. Agostino has been openly speaking to the press, something that Milestone disagreed with.
Judge Michael Gotsch ruled to ensure a fair trial. He said a restraining order was "too broad." He denied the Gag Order, but did give some limitations. Neither party is to hold periodic press conferences and all clients must consult with attorneys first before speaking with the press.
"I think the judge made a fair ruling and we're going to abide by it. Overall, we're pleased with it," Agostino said following the hearing. Milstone didn't have a comment. Stay tuned to FOX28 as we continue to follow this story.
