Tape drama continues in South Bend. The South Bend Common Council issued a subpoena for the mayor to release tapes of recorded phone conversation by the South Police Department.
The mayor has not released the tapes. He says his office is waiting for approval from a Federal Court.
The mayor's office issued this statement, Monday afternoon:
"The
City believes the best course of action is to get an answer in Federal
Court, which is why the City issued a declaratory judgment action weeks
ago. There are
serious legal questions unresolved and while the administration doesn't
want to be unresponsive to Council, we do want to follow a court order
or ruling on this issue."

The Common Council's attorney, Spencer Walton, wants to speed up the process by having a local court rule on the tapes.
"We just want to get this thing moving as fast as we can. We frankly don't care which court decides it. Whoever decides it first would be best for the community," says Walton.
The next hearing will take place October 2.
