Care giver charged with neglect after toddler choked to death

A child care worker involved in the death of an 18 month old has been arrested on a Neglect of a Dependent charge.

Peyton Bretell died back in August from positional asphyxia.  Peyton was being cared for by Dana and Ballard Shell at their home.  The two were running an unlicensed day care.

Two other relatives found the toddler unresponsive in a bedroom of the home.  Investigators say Peyton had been partially strapped into a car seat in the home.  They say Dana Shell told them there was a concern with the child in the seat, but did not take any immediate action to care for the child or report it to police or EMS.

Authorities do not believe that anyone else in the home was aware of problem with Peyton until he was found.

Dana Shell was arrested Monday and is currently being held in the Kosciusko County Jail.  She is being held on $50,000 bond.
