A judge has accepted the Elkhart County Prosecutor's recommendation to dismiss the charges against a woman convicted of being an accomplice to murder.
Lana Canen was convicted in 2005 as an accomplice in the murder of Helen Sailor. Prosecuting Attorney Curtis Hill says the case was largely based on a finger print recovered from the scene of the crime.
The Elkhart County detective who identified the fingerprint as Canen's back in 2005, Dennis Chapman, said last month that he made a mistake. Chapman was disciplined by the Elkhart County Sheriff, but it not released as to how.
"After reviewing the file, and reexamining the trial as well as the evidence available going forward," explained Hill, "there is insufficient evidence in which to proceed with the criminal prosecution of Lana Canen."
Hill says that a judge has approved his recommendation and, to his knowledge, Canen has been released.
