Death of Edward Mwaura deemed justifiable homicide

The St. Joseph County Prosecutor's Office has determined that police acted appropriately when the shot and killed Edward Mwaura on June 2.

Police shot Mwaura in his ex-wife's home while, they report, he was stabbing his 6-year-old daughter, Shirley Mundia.  Police fired two shots, both hitting Mwaura and killing him.  Mundia died a short time later from her injuries.

Mwaura's ex-wife, Lucy Mundia, told police that Mwaura had taken several knives and attacked her after he arrived at the apartment and she told him that he was not welcome.

According to the Prosecutor's Office, a Deputy Prosecuting Attorney decided not to prosecute Mwaura for the May 30 arrest because their review found an invalid protective order.  The prosecutor's office says there was a valid order, and the release of Mwaura should not have happened.
