Wilk will not be tried a third time for neglect

The St. Joseph County Prosecutor's office will not push for a third trial in the neglect case against Jacqueline Wilk.  Wilk was indicted back in May of 2012 on two counts of Neglect of a Dependent.

The prosecutor's office says they do not think they can get a conviction in a third attempt.  They have filed a motion with the court on Monday to dismiss the case.  The motion was accepted later that day.

Wilk's to sons, Dominck (4) and Isaac Jr. (2), died of hyperthermia in June 2011 after becoming trapped inside the trunk of a car while playing. 

Wilk's case has gone to trial twice.  Both times, juries were unable to reach a verdict and a mistrial was declared.
