Public Access Counselor: South Bend did not violate records law

Indiana's Public Access Counselor has responded to a complaint against the City of South Bend by Common Council Member Valerie Schey.

Schey believed the city violated the Access to Public Records Act by failing to respond or failing to provide several records she requested by email between March and April of 2013.

The Public Access Counselor says the city didn't violate the records law. In an 8 page advisory opinion, the Counselor points out Schey did not follow an agreed upon procedure for Common Council members to request information from the administration.

The Counselor also points out Schey did receive all the records and information she requested on May 30 and June 4.

"I am not surprised by this ruling in our favor, and am glad the Public Access Counselor has helped clarify procedures for public records requests under state law," South Bend Mayor Pete Buttigieg said in a written statement. "I remain proud of our administration's record on transparency, handling over 2,000 public records requests in just 18 months, without one violation. I hope we can now focus on upholding a reasonable process for information sharing. Citizens expect us to work together, and my door remains open to Council member Valerie Schey."
