Elkhart Mayor vetoes sewer fee ordinance


Delivering on a promise made after the vote, Elkhart Mayor Dick Moore says he has vetoed a hotly debated sewer fee ordinance.

The Elkhart Council passed the ordinance last week after a two hour-long debate. Under the ordinance passed by the Council, sewer customers outside the city limits would pay a 15% fee on top of what those inside Elkhart city limits pay.

In a release, Mayor Moore says the city's attorneys have determined the ordinance to be illegal, invalid and unenforceable. The release also says the Mayor doesn't believe it is in the best interest of commercial interests and industrialism inside the city, nor fair to city taxpayers.

Mayor Moore had submitted a plan to charge people outside of the city 35% of their property value for sewer service, which the Council rejected.

Without a new ordinance, a fee of 75% remains in effect.

In Friday's release, the Mayor says he is already working on yet another proposal. The Mayor also says plans to annex companies who are already connected to the system are already in place. Once annexed, sewer users would no longer have to pay the additional fees.
