Official complaints filed against South Bend Councilman

Formal complaints have been filed against a South Bend Common Councilman. The City Clerk's office says seven complaints were filed against Henry Davis Jr., Wednesday. The complaints stem from a Facebook post on the Councilman's Facebook page.

Constituent Becky Kaiser is one of the people who filed a complaint. She says she was shocked by what she calls an obscene post and describes it like this,  "It was a picture of a man and a dog in an unnatural situation, and then Mr. Davis likened that to homosexuality."

Kaiser says the picture was posted on Davis' Facebook page that is associated with the common council.

Kaiser is upset he would post the picture to a page associated with the Council, "That's a title that means that he has some responsibility to the people of his district and the people of South Bend." She says, "If he wants a "Henry Davis" page that's vile, vulgar and ugly, that's fine, but don't be putting it out there as if it's something to do with city business. It has nothing to do with city business."

The picture has since been taken down.

Councilman Davis later posted this:

"Sorry if I offended any of you in my last post. I read, see and hear all kinds of stuff everyday and at this juncture in my life it doesn't surprise me or offend me. People do not surprise me with their actions anymore. Sorry for sharing something that I thought should be read. Forgive me because I wanted to share a reading."

He followed-up that post with this statement: 

I regret that an article posted to my Facebook page was mistakenly taken as an expression of my personal or political views.

My Facebook and Twitter outlets are used as a platform to inform and generate discourse and debate on topics ranging from the mundane to the controversial. The wide ranging commentary and views expressed on these mediums by "friends" and "followers" create a virtual public square.

My regular and consistent interactions with my constituents via meetings, phone calls, and emails help to inform my views on a range of issues. Most recently, I voted in favor of the resolution "Urging General Assembly to Reject the Proposed State Constitutional Amendment Permanently Defining Marriage." Because of the ongoing dialogue I maintain with my constituents in South Bend, my understanding of the diversity of family, partnerships, and same sex equality has evolved.

As your 2nd District Common Councilman, I look forward to continuing to serve all the constituents of the 2nd District.

Both of those statements were posted on January 27th.
 
Council President, Oliver Davis says Legal Counsel is reviewing the complaints. He says once that review is done, he will call a Rules Committee meeting to discuss any potential action.
