Former Warsaw public works superintendent, 2 others, arrested on corruption charges

Three people, including the former City of Warsaw Public Works Superintendent, have been arrested for embezzling nearly $250,000.

Tuesday around 9:15am, ProForm Pipe Lining owner Marc Campbell, Kevin Brown, a ProForm Field Supervisor, Lacy Francis, Jr., the former Warsaw Public Works Superintendent, were all arrested and search warrants executed following a three month investigation into billing irregularities between the Warsaw Public Works Department and Mishawaka based, ProForm Pipe Lining Co, Inc.

According to court documents, an anonymous tip was given to the Warsaw Police Department by a former employee of ProForm Pipe Lining about possible overcharging for a number of pipe lining projects.

Mayor Joseph Thallemer says he and the city engineer were informed by police about the possible overcharging in December 2013.

The police investigation revealed eleven billing discrepancies between May 2011 and May 2013 totaling about $250,000.

According to court documents, police were told by the tipster, known in the documents as "JS," that ProForm had been intentionally over billing the city of Warsaw for the last several years. The over billing included charging the city for more feet of pipe lining than what had actually been installed.

Documents say "JS," and another source in the company, know as "BL," told police during their employment with ProForm they were instructed through their supervisor, Kevin Brown, to add 100-feet to every Warsaw project.

Warsaw Mayor Joseph Thallemer says when it the case was first brought to his attention, he says he didn't believe Public Works Superintendent Lacy Francis had part in the ProForm embezzlement scheme. Upon further investigation, and after sitting down with Francis and the Warsaw Police, he says it became clear Francis was involved. Francis resigned in January of 2014.

Mayor Thallemer says he's been mayor for nearly 2 1/2 years and never imagined dealing with a case like this.

Each of the three charged is being held on $25,000 surety bond.

The Warsaw Police Department along with the Kosciusko County Major Crimes Unit, Indiana State Police, Mishawaka Police Department, St. Joseph County Police Department, and the FBI, in coordination with the Kosciusko County Prosecutor's Office, and the United States District Attorney's Office, are all involved in the investigation.
