Hearing on Benton Harbor Mayoral Recall scheduled for Tuesday

A Berrien County judge will decide whether to impose a stay on the Benton Harbor Mayoral Recall election Tuesday morning.

A hearing will be held at 10:00am Tuesday to consider the stay on the May 6 election requested by the Berrien County Clerk, stemming from charges brought against the recall's organizers. Rev. Edward Pinkney turned himself in and pleaded not guilty Friday to charges of election forgery and allowing people to sign recall petitions more than once.

The charges against him and fellow recall organizer James Cornelius have led to County Clerk Sharon Tyler requesting the election be postponed until "a full examination of the involved Recall Petitions and proper adjudication of the sufficiency of the Recall Petitions can occur."

The hearing on the stay request will be held in the court of Hon. John Dewane in the Berrien County Courthouse. The recall election scheduled for May 6 featured Benton Harbor Mayor James Hightower running against City Commissioner Marcus Muhammad, who filed a petition to be on the ballot after the recall was originally approved.
