Elkhart County delays issuing marriage licenses to same sex couples

Elkhart County delays issuing marriage licenses to same sex couples

While It seemed pretty simple in St. Joseph County Wednesday, it wasn't as easy in Elkhart County. They didn't start giving marriage licenses to same sex couples right away, instead, they waited until they essentially got permission from the Attorney General.

Early Wednesday afternoon, the Elkhart County Clerk told us they were not issuing marriage licenses to same sex couples because they did not want to issue a license that could become invalid if the ruling was overturned.  When we tried to talk to the County Clerk about this decision around 2 p.m. we were told she was too busy to talk to us.

But just after 3:30 p.m. the Attorney General told Elkhart and other Counties it was ok to issue the marriage licenses.

Just after 4 p.m. County Clerk Wendy Hudson told us the County gave out two marriage licenses to same sex couples, before the office closed at 4.

Chad Crabtree said he is overjoyed Indiana's ban on same sex marriage was overturned by a federal judge.  "The constitution says everybody's equal, they have the right to marry no matter what state they live in. "

But he was disappointed to hear in his County, Elkhart County, the Clerk didn't issue marriage licenses to same sex couples right away.  "They should uphold the law if a federal judge threw out the ban, they should uphold that until the attorney general appeals it."

"It doesn't surprise me that Elkhart County was cautious, that's been their nature." said Owner of New Paradigm Brewery, Brandon Stanley.
Stanley is ordained so now that the ban on same sex marriage has been overturned, he's offering free marriages at his brewery through Saturday night.   "I think it's fantastic, marriage is about love, it's not about anything else."

Several other counties in our area did the same thing as Elkhart and waited to hear from the attorney general before issuing marriage licenses to same sex couples.

Fulton County told us even after they received word from the Attorney General Wednesday afternoon they still weren't issuing marriage licenses because they are now waiting for their legal department to interpret what the Attorney General said.
