UPDATE: Marshall County will grant same-sex marriage licenses

PLYMOUTH - UPDATE: The phones have been ringing at the Marshall County Clerks office...

Bethany Ross says mostly calls are just inquiring about if we've changed the law or not, but a few of them have identified themselves as seeking a marriage license for them and their partner.
A federal judge shot down the gay marriage ban Wednesday, saying it was unconstitutional. The Attorney Generals office was then in charge of giving each county the go-ahead to issue a same sex marriage license. Marshall County Clerk Julie Fox says her office was waiting for that call from the AG's office.

Marshall County Clerk Julie Fox says, "They notified us about 3 o'clock yesterday afternoon." Since then, gay couples across the state rushed in to get their marriage license. But Thursday morning in Marshall County, Fox says, "We've had no applicants come in. I don't know why..."

But before the office closed Thursday at 4:00 PM, the clerks office issued ONLY TWO same-sex marriage licenses. Fox says it was a bit surprising since couples can apply at home,"Through our website, there's a link for marriage licenses where they can do it in the comfort of their own home," says Fox.
But questions are on the horizon surrounding Indiana Attorney General Greg Zoeller requesting an emergency stay and pushing for an appeal. Fox says the Attorney Generals office has been in good communication with the Marshall County Clerks office. She says if there's a stay or an appeal, they will abide by the law and say no to same-sex marriage licenses.

PREVIOUS: St. Joseph County started granting same-sex marriage licenses around 1:00pm Wednesday. Elkhart, and many other Indiana counties waited until word came from the Attorney General later in the afternoon. But at mid-day Thursday, Marshall County is still not granting same-sex marriage licenses, and say they have yet to receive any word on when or if they should start.
FOX28 spoke to the Marshall County Clerk's office, and they said they have checked all their emails and have yet to receive any written communication telling them to grant same-sex marriage licenses. A message has been left with the Attorney General's office seeking explanation.
