Police officers drop South Bend and Common Council from slander suit against Henry Davis Jr.

SOUTH BEND - The four police officers suing South Bend Common Councilman Henry Davis Jr. for libel are dropping the city government from their lawsuit.
"This lawsuit against Henry Davis has never been about money," said attorney Dan Pfeifer. "It's always been about the accountability of him for his actions."

Pfeifer says his clients are dropping the South Bend Common Council and the city from their slander lawsuit. He says they made that decision over the weekend, after reading reports on how much legal fees the suit has already cost South Bend taxpayers.

"The common council and the city don't need to be spending any more money," said Pfeifer.

Officers Tim Corbett, Bryan Young, Steve Richmond, and David Wells filed a lawsuit in March accusing Davis of libel and defamation of character, and accused him of listening to illegally recorded phone conversations and distributing information gained from it to the public. Originally the city of South Bend and the Common Council were included in the lawsuit, but the officers are now dropping both from the lawsuit and focusing solely on Davis, Jr.

"If you say that is OK, then God help us all," said Pfeifer. "Because what's to stop anybody else from recording a conversation, and then wanting to disseminate that recorded conversation when the people who are on the conversation, don't know it's being recorded."

In a release from their attorney, the officers cite concerns about taxpayer dollars being used for the legal defense of the city and the Common Council. A copy of the Common Council budget estimated $125,000 for legal expenses.

They claim any money received in the case will be donated to a charitable fund for police officers.
