SB Councilman Henry Davis Jr. trial date announced

SOUTH BEND - After being arrested over the weekend, South Bend Common Councilman Henry Davis Jr. will appear in Traffic and Misdemeanor Court on August 11th at 8 in the morning. 

He was charged this past Saturday with Operating a Motor Vehicle While Intoxicated, a Class C Misdemeanor, and Operating a Motor Vehicle While Intoxicated (Endangerment), a Class A Misdemeanor.

The St. Joseph County Court affidavit says Davis was spotted driving westbound in the eastbound lane on the bypass shortly after 3:00 AM. on Saturday. After dispatch was notified, police stopped Davis near Crumstown Highway. 

When the officer asked if Davis knew he was driving on the wrong side of the road, Davis said he knew, but did not know how he got there.
The officer notes that Davis' eyes were bloodshot, and his breath smelled of alcohol.

Davis agreed to several field sobriety tests, which the officer determined he failed. In a Portable Breath Test (PBT) Davis registered a .14 blood alcohol level. The officer says Davis only blew lightly. 

To confirm these field sobriety tests, police asked Davis to consent to a chemical sobriety test, with certified breath test equipment. Davis agreed to go to the Mishawaka Police Department to complete the test, but after arriving at the department, he declined. During the traffic stop, Davis said, "I was drinking, but I'm not drunk," when asked if he'd been drinking.
